These Terms of Service (“Terms”) govern your access to and use of the Roar Promo website, products, services, communications, ordering systems, and related services.

By accessing www.roarpromo.com, submitting an inquiry or order, or using our services, you agree to these Terms.

Separate consent may be required for certain marketing communications, including promotional SMS or automated telephone communications. Simply using our website does not constitute consent to receive marketing SMS messages.

Roar Promo provides custom promotional products, branded merchandise, corporate gifts, apparel, drinkware, bags, office products, event merchandise, and related customization, sourcing, artwork, and fulfillment services.

Product availability, decoration methods, pricing, production schedules, and other specifications may vary.

Quotes and Pricing

Prices displayed on the website may be estimates or starting prices and may vary based on factors including:

• Quantity
• Product availability
• Decoration method
• Number of imprint colors
• Artwork requirements
• Setup charges
• Shipping destination
• Production location
• Rush production
• Taxes
• Freight or delivery charges

A final quotation or order confirmation may supersede pricing displayed on the website.

Obvious typographical, technical, or pricing errors may be corrected before an order is accepted or produced.

Orders and Acceptance

Submitting an order, quote request, purchase order, or payment does not necessarily constitute final acceptance by Roar Promo.

An order may require confirmation of product availability, artwork approval, payment arrangements, production capacity, or other requirements before production begins.

Roar Promo may decline or cancel an order when reasonably necessary, including because of product availability, pricing errors, payment issues, prohibited artwork, production limitations, or suspected fraud.

Artwork and Customer Materials

Customers may provide logos, trademarks, artwork, photographs, text, designs, or other materials for use on customized products.

By submitting materials to Roar Promo, you represent that you have the necessary ownership, licenses, permissions, and authority to use those materials and authorize Roar Promo and its production partners to reproduce them for purposes of fulfilling your order.

Roar Promo is not responsible for determining ownership of intellectual property submitted by customers.

You agree not to submit content that infringes another person’s copyrights, trademarks, publicity rights, privacy rights, or other legal rights.

Proof Approval

When a digital or physical proof is provided, the customer is responsible for reviewing it carefully before approval.

This includes reviewing:

• Spelling
• Artwork
• Logo placement
• Product selection
• Colors
• Sizes
• Quantities
• Imprint locations
• Contact information
• Dates and other details

Once a proof is approved and production begins, changes may not be possible and may result in additional charges.

Color and Product Variations

Roar Promo makes reasonable efforts to accurately represent products and decoration.

However, colors displayed on screens may differ from physical products. Product dimensions, materials, manufacturing batches, PMS colors, decoration results, and other characteristics may have reasonable manufacturing variations.

Exact color matching cannot always be guaranteed across different products, materials, production methods, or production runs.

Production and Delivery

Production and delivery dates are estimates unless Roar Promo specifically agrees otherwise in writing.

Delivery times may be affected by product availability, artwork approval, customer delays, production schedules, shipping carriers, customs, weather, supply-chain interruptions, or events outside Roar Promo’s reasonable control.

Roar Promo is not responsible for delays caused solely by third-party carriers or events outside its reasonable control.

Returns and Customized Products

Customized, decorated, printed, engraved, embroidered, or otherwise personalized products generally cannot be returned because of a change of mind.

Products that are materially defective, damaged, or produced incorrectly should be reported promptly after receipt in accordance with Roar Promo’s applicable Sales Terms or return policy.

Purchase-specific policies displayed in Roar Promo’s Sales Terms, quote, order confirmation, or invoice may contain additional conditions.

Payment

Customers agree to pay all amounts associated with accepted orders, including applicable product costs, setup charges, decoration charges, shipping charges, taxes, rush fees, or other agreed charges.

Payments may be processed through third-party payment processors.

SMS/MMS Messaging Terms

Roar Promo Marketing SMS Program

When you separately opt in to receive promotional or marketing SMS/MMS messages from Roar Promo, you authorize Roar Promo to send marketing text messages to the mobile number you provided, including messages that may be sent using automated technology.

Marketing messages may include promotions, discounts, product announcements, seasonal campaigns, special offers, corporate gifting information, promotional product information, and similar marketing communications.

Message frequency varies. Message and data rates may apply.

Reply STOP to opt out. Reply HELP for assistance.

Consent to marketing SMS messages is not a condition of purchasing products or services from Roar Promo.

You may withdraw SMS marketing consent at any time by replying STOP.

After opting out, you may receive a confirmation message acknowledging your request. You will not receive additional marketing text messages unless you subsequently opt in again.

Wireless carriers are not responsible for delayed or undelivered messages.

Email Marketing

Roar Promo may send promotional emails in accordance with applicable law.

Marketing emails may include information concerning products, promotions, discounts, corporate gifting, new products, seasonal campaigns, events, or other Roar Promo offerings.

Recipients may unsubscribe from marketing emails using the unsubscribe instructions contained in the email.

Requests to stop marketing emails will not prevent Roar Promo from sending necessary transactional communications concerning an order, quote, payment, customer-service request, or other existing business relationship.

Telephone Communications

Roar Promo may make telephone calls regarding inquiries, quotes, orders, customer service, or business matters.

Where applicable, individuals may separately consent to receive marketing telephone calls from Roar Promo.

If a particular type of telephone marketing requires consent under applicable law, Roar Promo will only make such calls after obtaining the legally required consent.

You may ask us to stop making marketing calls to your number by informing the representative or contacting us at support@roarpromo.com.

Intellectual Property

Unless otherwise indicated, the Roar Promo website, branding, text, graphics, layout, photographs, software, and other original content are owned by or licensed to Roar Promo and are protected by applicable intellectual-property laws.

Customers retain their rights in artwork and materials they submit to Roar Promo.

Acceptable Use

You may not misuse the website or services to conduct unlawful activity, interfere with website operation, attempt unauthorized access, transmit malicious software, impersonate another person, commit fraud, or violate another person’s intellectual-property or privacy rights.

Third-Party Services

Certain portions of our services may depend on third-party payment processors, carriers, suppliers, manufacturers, decorators, hosting providers, communications providers, shipping companies, and other service providers.

Roar Promo is not responsible for independent third-party services outside our reasonable control.

Disclaimer

Roar Promo makes reasonable efforts to provide accurate product, pricing, availability, and website information.

Except to the extent required by law, the website and related services are provided on an “as available” basis and Roar Promo does not guarantee uninterrupted or error-free operation.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Limitation of Liability

To the fullest extent permitted by applicable law, Roar Promo will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the website or services.

Nothing in these Terms limits liability that cannot lawfully be limited.
